Thank you for visiting the Panoplie website, (the “Website”). Panoplie provides services to you through our Website subject to the following Terms and Conditions (the “Terms and Conditions”). The Terms and Conditions applies to any person (collectively “you”, “your” or “I”) who accesses this Website, views the contents of this Website, order products from this Website, and/or completes the registration process to open and maintain an account with Panoplie (collectively, the “Services”).
When you view or use any part of this Website and/or shop or purchase any products from this Website, you are agreeing to and consent to be bound by all of the Terms and Conditions set forth herein. If you do not agree to the Terms and Conditions, you do not have our authorization to use any portion of this Website and/or order any product from this Website.
CONSENT & RELEASE
By accessing this Website, you expressly acknowledge and consent to viewing products and services of and related to Panoplie and you release and forever discharge Panoplie, its directors, officers, employees and agents from any and all claims and liabilities whatsoever, whether known or unknown, suspected or unsuspected, both in law or equity, arising from or on account of any matter, cause, or event occurring as a result of viewing and purchasing the contents included in this Website.
By placing an order within this Website or through other Panoplie sales channels such as telephone orders, mail orders or our physical stores, 1). you may be asked to supply certain relevant information, such as your credit card number and its expiration date, your billing address, and your shipping information 2). you represent and warrant that you have the right to use any credit card that you submit in connection with a transaction. 3). you represent and warrant that you are an adult over the age of 18 and are legally capable of entering into binding contracts.
LICENSE & WEBSITE ACCESS
Panoplie grants you a non-exclusive, limited license (the “Limited License”) to access and make personal use of this Website and you agree not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Panoplie. Unless explicitly granted, this Limited License does not include any resale or commercial use of this Website or its contents or any derivative use of this Website or its contents. In the event that you engage in any unauthorized use of this Website, the Limited License will immediately be terminated.
Our products are vintage and artisanal items that are sold as is and often show imperfections. We have made every effort to display as accurately as possible the colors and images of our products that appear on this Website. We cannot guarantee that your devices monitor display of any color will be accurate.
All sales on vintage, art, and custom items are final and we do not offer returns or exchanges. For new production items that are not damaged or used, we offer a 7-day return policy for a store credit. Return shipping costs are the responsibility of the buyer.
Panoplie is not responsible for any errors made by the customer when providing shipping addresses. Any costs associated with reshipping or restocking are the responsibility of the customer. On all returned orders, Panoplie will hold packages for 45 days, after which packages or cargo which are not collected will be destroyed.
Shipping costs are calculated on a "per order," "per item" or "per pound" basis and are based on the shipping option you select. We sometimes offer free shipping. You can see each product's estimated arrival date on the checkout page during the checkout process. During checkout, you can choose an estimated arrival date from the options provided. Orders are generally shipped within one business day from order receipt.
All orders shipped outside the United States will include customs declarations for local customs at destination. All customs and duties at destination are the responsibility of the Importer (customer) not the Exporter (Panoplie). International taxes and duties must be paid by the Importer (customer) upon receipt; the Exporter (Panoplie) does not calculate or collect these fees. Should items be held in customs at destination it is the responsibility of the Importer (customer) to retrieve their order, not the Exporter (Panoplie). Panoplie is available upon written request to provide all export documentation within a reasonable time frame. Panoplie is not available to modify or manipulate invoices to suit Importer (customer) at any time.
Panoplie does not accept any liability for lost packages shipped outside the United States by United States Postal Service. On all returned orders shipped to address outside the United States, Panoplie will only refund the cost of goods, not the shipping costs or 25% restocking fee.
All orders shipped on Shippers (Panoplie) accounts with courier or postal tracking receipts showing that goods have been delivered are no longer the responsibility of the Shipper (Panoplie). All orders shipped by the Shipper (Panoplie) are sent without the requirement of direct or indirect signature by Receiver (customer). Receiver (customer) understands that orders are sent uninsured and understands the risks associated with uninsured shipping.
For orders shipped on Receiver (customer) courier or freight accounts or Receiver (customer) third party nominated courier or freight accounts, Shipper (Panoplie) is no longer responsible for Receiver (customer) order after packages or cargo are received by nominated courier or freight carrier. Shipper (Panoplie) is not responsible for Receiver (customer) errors in instructions, Receiver (customer) will indemnify and hold Shipper (Panoplie) harmless from all financial responsibilities for Receiver (customer) nominated courier or freight charges and any customs duties at destination.
On all refused / undeliverable orders within the United States, regardless of reason, Panoplie will only refund the cost of goods not the shipping costs or restocking 25% fee.
IN STORE PICKUP
In store pickup is only available during listed business hours. Orders are only available for pickup starting at time stated on tracking email confirmations. For orders not collected within three business days, Panoplie reserves the right to move order item(s) to a storage location. On all orders, Panoplie will hold items for 45 days, after which item(s) that are not collected will be destroyed.
All content and compilation of all content included on this site are the exclusive property of Panoplie and protected by United States and international copyright laws. Panoplie, the Panoplie logo, panoplie.com, and other marks indicated on this Website are trademarks and trade dress, as applicable, of Panoplie and may not be used in connection with any product or service that is not offered by Panoplie, or in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Panoplie. These and other graphics, logos, service marks, trademarks and trade dress of Panoplie used on this Website may not be used without the prior written permission of Panoplie.
Any disputes arising out of or relating to these Terms & Conditions, be resolved in accordance with the laws of the state of California.
